In Insurance fraud case GH woman receives $1.2 million judgment

A Grove Hill woman was awarded $1.2 million judgment in circuit Court in Mobile Wednesday morning.

Gil Gilmore, Grove Hill attorney for Mattie Foster, said Life of Georgia Insurance was ordered to pay Ms. Foster $1,250,000 in damages. Gilmore said the company sold her a Medicare supplement insurance policy when she was not even on Medicare. The company collected premiums for 38 months and when Ms. Foster made a claim, denied it.

Of the total $250,000 was to compensate Ms. Foster for her actual loss, pain and suffering. The $1 million was imposed as punishment to the company.

Ms. Foster's actual outlay for premiums was $2,468 over the 38-month period but Gilmore noted that her income was only $407 a month and that the monthly premium represented 30 percent of her income.

Gilmore said the case was tried in Mobile because Life of Georgia does so much business there.

Sid Jackson, Mobile attorney was co-counsel in the case.
